A spill response plan is not paperwork for its own sake — it’s the document that tells every worker in your facility exactly what to do in the first 30 seconds after a spill, before a small incident becomes a large one. US facilities covered by OSHA HAZWOPER, EPA SPCC, or state environmental regulations are required to have written spill response procedures. Facilities that aren’t covered by those specific rules still benefit from a plan: uncontrolled spills cost cleanup time, create worker injury risk, and generate regulatory exposure that a written plan prevents. This guide walks through how to build one that works.
Step 1 — Inventory Your Spill Hazards
You can’t plan a response to a hazard you haven’t identified. Start with a site walk and document every location where a spill could occur:
- Bulk liquid storage — drums, totes, tanks, and above-ground storage tanks
- Transfer and decanting areas where containers are opened and liquids moved
- Chemical use areas — production lines, laboratories, maintenance shops
- Loading and unloading docks where deliveries of liquid materials arrive
- Generator fuel storage and vehicle fueling areas
- Process equipment with hydraulic systems, coolant circuits, or lubricant reservoirs
For each location, record: what liquid is present, the maximum volume that could be released, and the nearest floor drain or water body that a spill could reach. This inventory becomes the hazard assessment that drives every other element of your plan.
Step 2 — Identify Your Regulatory Obligations
Before writing a plan, confirm which regulations apply to your facility:
- OSHA HAZWOPER (29 CFR 1910.120): Applies if you handle hazardous substances above CERCLA reportable quantities, operate a TSD facility, or conduct emergency response operations. Requires a written emergency response plan, trained response personnel, and documented drills.
- OSHA Emergency Action Plan (29 CFR 1910.38): Applies to all facilities with employees. Requires written procedures for evacuation, accounting for employees, and reporting emergencies — including spills that trigger evacuation.
- EPA SPCC (40 CFR Part 112): Applies if you store oil above threshold quantities and are located where a discharge could reach navigable US waters. Requires secondary containment, inspection protocols, and a certified SPCC Plan.
- State environmental regulations: Many states have spill reporting requirements that are stricter than federal minimums. Your state environmental agency’s website will have reportable quantity thresholds and notification procedures.
Step 3 — Define Incidental vs. Emergency Releases
This is the most critical distinction in your plan. OSHA defines an incidental release as one that does not pose a significant safety or health hazard and can be cleaned up by employees familiar with the substance. An emergency release requires evacuation and calling professional responders.
Your plan must provide clear, chemical-specific criteria that workers can use to make this determination in real time. A common framework:
- Incidental: Volume under [X gallons], substance is [list of non-acutely hazardous materials], spill is contained on impervious surface, no vapor release, trained worker with appropriate PPE can clean up within [Y minutes]
- Emergency: Volume exceeds [X gallons], substance is [list of acutely hazardous materials], spill is spreading toward drain or floor penetration, vapor release detected, fire or explosion risk present
Define these criteria in writing for each chemical category at your facility.
Step 4 — Stage Your Response Equipment
Equipment that isn’t immediately available is equipment that doesn’t work. For each hazard location identified in Step 1, designate staged response equipment:
- Spill kit: Correct type (universal, oil-only, or hazmat) and adequate capacity for the largest foreseeable spill at that location
- PPE: Nitrile gloves minimum; chemical splash goggles and apron for hazmat areas
- Disposal bags and labels: For containing and identifying used sorbent materials as regulated waste where applicable
- Emergency contacts: Posted at each kit location — internal EHS contact, facility emergency number, and the National Response Center (1-800-424-8802) for federally reportable releases
Document every kit location on a site map and include the map in your plan. OSHA inspectors will verify that equipment is staged as the plan describes.
Step 5 — Write the Response Procedures
For incidental releases, your written procedure should cover:
- Alert coworkers and clear the immediate area of non-responding personnel
- Don appropriate PPE before approaching the spill
- Identify the substance (SDS location, container label)
- Stop the source if safely possible — close valve, right the container, plug the leak
- Deploy sorbent socks around the spill perimeter to prevent spread to drains
- Apply sorbent pads from the outside of the spill toward the center
- Collect used sorbents in labeled disposal bags
- Report the incident per your internal reporting procedure
- Restock the spill kit before returning it to its staging location
For emergency releases: evacuate, account for all personnel, call 911, notify the National Response Center if a reportable quantity of a hazardous substance was released, and do not re-enter until cleared by emergency responders.
Step 6 — Train Your Workers
A plan that workers haven’t read and practiced doesn’t function in an emergency. Training requirements:
- All workers in areas with spill hazards must be trained on the substances present, the PPE required, and the incidental release procedures for their area
- HAZWOPER-covered facilities must train designated responders to the awareness, operations, or technician level as appropriate to their role
- Annual refresher training for all trained responders
- Documented training records — name, date, content covered, and trainer signature
Step 7 — Test and Update Your Plan
SPCC-covered facilities must conduct drills. All facilities benefit from them. An annual tabletop exercise where supervisors walk through a spill scenario identifies gaps in equipment, procedures, and training before a real incident does. Update your plan whenever: chemicals stored at the facility change, facility layout changes, regulatory requirements are updated, or an actual spill or near-miss reveals a gap.
